Men in Scotland who were prosecuted in the past for homosexual acts can now apply to have their convictions completely erased through the ‘Historical Sexual Offences (Pardons and Disregards) Act 2018’ and they can also apply for them to be erased under the central criminal records. This will grant a pardon to these men who were convicted against a background of laws that are discriminatory. The Justice Secretary has stated: “This landmark legislation provides an automatic pardon to men convicted of same-sex sexual activity, which is now entirely legal. We have been working closely with Police Scotland and other partners to ensure the ‘disregard’ scheme is clear and effective and has appropriate safeguards in place.”
