South Lanarkshire Council sought an antisocial behaviour order against Andrew Cunningham due to complaints about his disruptive actions, including loud music, noise, and threatening behaviour towards neighbours and council staff. A key incident was a threatening phone call in which Cunningham said he would punch a housing officer, M, in the face.

Cunningham denied the allegations, suggesting they were fabricated, but Sheriff Speir found the evidence, including the phone call, compelling. Although Cunningham had successfully completed addiction treatment and refrained from further incidents since October 2023, the sheriff rejected his claim that the complaints were part of a conspiracy.

He concluded that a less restrictive final order was appropriate, recalling the interim order and imposing a three-month order with reduced terms. The sheriff emphasized that Cunningham’s past behaviour, while influenced by personal difficulties, could not be tolerated.
