In 2024, RF, a Norwegian citizen, faced extradition from the UK to Norway on charges of raping and abusing his ex-wife, X, and their children. 

He argued that extradition would violate his and his wife Y’s rights to family life under Article 8 of the European Convention on Human Rights, particularly given Y’s deteriorating mental health. Despite evidence from Y and a psychiatrist about her condition, the sheriff in Edinburgh ruled that the public interest in extraditing RF outweighed the potential harm to Y.

The court allowed new evidence on Y’s deteriorating condition, but found it did not significantly alter the situation, as her prognosis remained bleak.

Lord Doherty emphasized the importance of bringing accused criminals to trial and upholding international obligations, noting that RF would face a long prison sentence even if convicted in Scotland.

The appeal was dismissed, and RF’s extradition was upheld.
