Mr Connelly’s case has been referred to the High Court of Judiciary in Edinburgh after the Scottish Criminal Cases Review Commission escalates matters believing he may have a case to appeal against a miscarriage of justice having taken place at the hands of the presiding sheriff. Mr Connelly was convicted in early 2017 at Paisley Sheriff Court under this Misuse of Drugs Act concerning the production of controlled drugs in Scotland and sentenced to 5 years imprisonment.
After a successful appeal at the Sheriff Appeal Court this sentence was reduced to 4 years. The detailed reasons for the referral have yet to be made public.
